1. About TreeJobs

TreeJobs ("we", "us", "our") operates an online marketplace platform at treejobs.com.au (the "Platform") that connects homeowners and property owners ("Customers") with independent tree service professionals ("Providers") across Australia.

By accessing or using the Platform, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Platform.

2. Platform Role — Marketplace Only

TreeJobs is a marketplace intermediary only. We do not employ, engage, supervise, or control any Provider. We do not perform any tree services ourselves, and we are not a party to any agreement entered into between a Customer and a Provider.

All tree services are performed solely by independent Providers. TreeJobs makes no representations or warranties about the quality, safety, legality, or suitability of any Provider or any services they offer.

3. No Liability for Services Performed

To the maximum extent permitted by applicable law, TreeJobs expressly disclaims all liability for:

• Any damage to property, personal injury, or death arising from tree services performed by a Provider;
• Any loss, damage, or expense arising from a Provider's failure to perform, delay, or defective workmanship;
• Any dispute between a Customer and a Provider;
• The accuracy or completeness of any information provided by a Provider on the Platform, including qualifications, licences, insurance, and reviews;
• Any fraudulent, negligent, or unlawful conduct by any user of the Platform.

Customers are solely responsible for verifying that a Provider holds appropriate licences, insurance (including public liability insurance), and qualifications before engaging them. TreeJobs does not verify Provider credentials.

4. User Responsibilities

All users agree to:

• Provide accurate, current, and complete information when creating an account or posting a job;
• Not use the Platform for any unlawful purpose or in any way that violates these Terms;
• Not post false, misleading, or fraudulent job listings or profiles;
• Not harass, abuse, or threaten other users;
• Comply with all applicable Australian laws and regulations.

Providers additionally agree to:

• Hold all licences, permits, and insurance required by law to perform the services they offer;
• Accurately represent their qualifications, experience, and service areas;
• Comply with all workplace health and safety obligations.

5. Payments

TreeJobs does not currently process payments between Customers and Providers. All payment arrangements are made directly between the parties. TreeJobs is not responsible for any payment disputes, non-payment, or financial loss arising from transactions between users.

6. Intellectual Property

All content on the Platform (excluding user-generated content) is owned by or licensed to TreeJobs. You may not reproduce, distribute, or create derivative works without our prior written consent. By posting content on the Platform, you grant TreeJobs a non-exclusive, royalty-free licence to use, display, and distribute that content in connection with operating the Platform.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

8. Account Suspension & Termination

TreeJobs reserves the right to suspend or terminate any account at any time, with or without notice, if we reasonably believe a user has breached these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our sole discretion.

9. Limitation of Liability

To the fullest extent permitted by law, TreeJobs' total liability to any user for any claim arising out of or in connection with the Platform shall not exceed AUD $100. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded by law (including under the Australian Consumer Law).

10. Indemnity

You agree to indemnify, defend, and hold harmless TreeJobs and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Platform, your breach of these Terms, or your violation of any third-party rights.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by a notice on the Platform. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
